On December 31, 2020, 23-year-old Tyler Smith was arrested in Dallas, Texas, for failure to register as a sex offender.
According to a later indictment, Smith had failed to provide the Dallas County Sheriff’s Office with information on his new address, as required by persons on the state’s sex-offender registry, between October 28, 2020, and November 19, 2020.
At the time, Smith had been released from prison after serving time on an unrelated conviction and was finishing his stay at the Dallas Transitional Center, a halfway house.
Smith, represented by Patrice Williams, pled guilty in Dallas County District Court on April 6, 2021, and received a sentence of six months in state jail. He was released on June 5, 2021.
On August 27, 2021, a detective with the sheriff’s office checked Smith’s status and found that he had not registered since his release from state jail. Smith was indicted on September 15, 2021, with a second charge of failure to register.
While that case was pending, the Texas Department of Public Safety Offender Registration Bureau began examining whether Smith was required to register.
The bureau contacted the Texas Juvenile Justice Department and requested Smith’s juvenile record. He had pled guilty in 2012, when he was 15 years old, to a sex crime and sentenced to two years of community supervision. At the time of the plea, the juvenile court judge deferred a decision on the registration until Smith completed his supervision. In July 2015, he was discharged from a treatment program and a month later discharged from probation. The judge had never entered an order requiring Smith to register, but an employee at the Texas Department of Correction had mistakenly entered Smith’s name in the sex-offender registry and told him that he would need to comply with its mandates upon his release.
The sheriff’s detective removed Smith from the registry on January 4, 2022, but did not tell the Dallas County District Attorney’s Office or Smith’s attorney about the decision.
On October 15, 2024, Smith’s father contacted the sheriff’s Sex Offender Registration Unit, and a new investigation began. The district attorney’s Conviction Integrity Unit (CIU) also reviewed the case, which led to the dismissal of the 2021 indictment for failure to register on November 7, 2024.
On May 21, 2025, Smith filed a state petition for a writ of habeas corpus. He said his due process had been violated because he never had any obligation to register. The petition said a failure to register is “akin to a ‘Scarlet letter’ that will follow him and disadvantage him for life.”
In its response, the state agreed that Smith had never been required to register and that he was therefore innocent of the crime.
After a judge recommended that the writ be granted, the Texas Court of Criminal Appeals granted the writ on March 31, 2026, vacating Smith’s conviction. A judge granted the state’s motion to dismiss the case on April 7, 2026.
